A CHARTER ORDINANCE EXEMPTING THE CITY OF WELLSVILLE, KANSAS FROM THE PROVISIONS OF K.S.A. 15-204 AND K.S.A. 15-209 RELATING TO APPOINTMENT AND DUTIES OF CITY OFFICERS.
Section 1. Exemption from Statutes: The City of Wellsville, Kansas, by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 15-204 and 15-209 and provide substitute and additional provisions as hereinafter set forth in this charter ordinance. Such statutes are state legislative enactments, or a part thereof, which are applicable to the City of Wellsville but are not applicable uniformly to all cities.
Section 2. Employment governed by: Employment of officers of the city, including, but not limited to, City Clerk, City Treasurer, Municipal Judge, City Prosecutor, City Attorney, City Engineer, Fire Chief, Chief of Police, City Administrator, or any other officer or employee that the Governing Body deems necessary to be employed by the City, shall be governed by the Wellsville City Code, the City of Wellsville Employee Handbook, and/or an individualized contract of employment negotiated by the officer with the Governing Body. Nothing herein shall be construed as affecting or altering any city employees’ or officers’ at-will employment status with the city, including all of the officers herein above mentioned.
Section 3. Amendment of City Code and Employee Handbook: Upon this charter ordinance becoming effective, the Governing Body shall amend those chapters of Title 2 of the City Code pertaining to appointed officers to be consistent with this charter ordinance. The Wellsville Employee Handbook shall also be made to be consistent with this charter ordinance.
Section 4. Repealer: Charter Ordinance No. 1 pertaining to the residency of the City Clerk is hereby repealed, as are any other city ordinances or City Code provisions inconsistent herewith.
